Accountable Person.

A duty-holder under the Building Safety Act 2022 for an occupied Higher-Risk Building. Anyone who holds a legal estate in possession in any part of the common parts, or who has a relevant repairing obligation in relation to the common parts.

Who is an AP.

An AP is anyone who holds a legal estate in possession in any part of the common parts of an HRB, or who has a relevant repairing obligation in relation to any part of the common parts. In practice the AP is often the freeholder, but it can also be a head leaseholder with a repairing obligation, a managing organisation acting under a long lease, or any other entity with a legal interest in the common parts.

AP duties.

Each AP carries duties in the scope of their legal estate or repairing obligation. The PAP carries lead-duty-holder responsibilities for the safety case as a whole. APs that are not the PAP must cooperate with the PAP and provide information needed for the safety case. The cooperation duty is an explicit statutory duty, not a courtesy.
